Cyclists are vulnerable. Very vulnerable. That is why the legislator expects motorists to take greater responsibility. In any case, the motorist in this video does not take this responsibility and almost kills a cyclist.
Consequences for the cyclist
In this case, the cyclist saves his life and the motorist loses – only – his driver’s license. If the cyclist had been less lucky, he would have been dead, or at least seriously injured.
The driver’s license is confiscated. There are also 2 fines issued for a total of €460. Share your thoughts with other readers. Click here and post a comment .
Motorist’s liability
The extra responsibility that the legislator expects from the motorist (and drivers of other motor vehicles) is reflected in the regulations that stipulate that, even if a cyclist makes a mistake , the motorist is almost always liable for at least 50% .
In the event of a collision between a cyclist and a car, the driver of the car is liable for at least 50% of the damage. This means that at least half of the damage must be compensated. There is only one exception to this, in case of force majeure.
Even if in this video the car had driven through green and the cyclist through red, the motorist would still be partially liable for the damage suffered by the cyclist. Case law even stipulates that the motorist’s liability percentage must be increased in the event of serious injury to the cyclist.
The idea behind this is that the driver of a “dangerous” motorized vehicle must always take into account the considerable damage that he can cause.
