Amendment of the Violent Offenses Compensation Fund Act
On 1 January 2012, the new Violent Offenses Compensation Fund Act (Wsg) will come into effect. What are the main changes of the new law?
- the group of next of kin who can appeal to the Schadefonds is expanded to include blood relatives of the deceased in the first degree and in the second degree in the collateral line (brother and sister);
- next of kin of victims of serious violent crimes are equated with victims. They may now also be eligible for compensation for immaterial damage or compensation for damages or costs of therapy;
- the maximum amounts for compensation for material and immaterial damage can be set by ministerial regulation. This makes it easier to change the amounts;
- since 2004, the Schadefonds has been operating in accordance with the General Administrative Law Act (Awb). This is now also regulated by law. The administrative judge of the District Court will become the professional judge and there will be an opportunity to appeal to the Council of State. To date, the appeal has only been lodged with the Court of Appeal in The Hague.
Transition Policy
In anticipation of the entry into force of the new law, the Violent Offenses Compensation Fund has drawn up policy rules. Based on these temporary policy rules, next of kin can already submit an application to be eligible for, among other things, compensation for their immaterial damage, as also included in the new law.
